oowopetu, cable and satellite companies cannot get around employee based service technicians. The providers will never accept a proper contract from a third party contractor and the contracts providers have are employee contracts. Third party contractors should be kept on the contruction side of the bus. Below are some examples why service tech positions can only be employee based positions.

Contractors have the right to or can legally decide without penalty.
1. Vehicle-they can drive what ever they want to drive.
2. Clothing-they can wear what ever they want.
3. Number of jobs per day-what ever the contractors agrees to complete.
4. Work days-contractor decides how many days per week they are going to work.
5. Vacation or Days off-contractor decides when to take these days.
6. Job cancellation for weather conditions-contractors decides on that day.
7. Retainers-are only legal if held until the job is satisfied by the terms of the contract.
8. Representation-they only have to represent their company and don't have to represent the provider.
9. Contractors don't have to work for free.
10. Contractors can't be told how to do the job, he does have specifications he must satisfy.

My point-providers cannot operate their service technician side of the bus and give up absolute control. That's why it's not working right now. The problem is some of us are service techs that have to make a living, so we have to take what they dish out. But we can use Uncle Sammy to help us. Make sure you include IRS Form SS8 with your 1040 this year and get your taxes possibly paid for by the company who is taking advantage of service techs.
